AN ACT relating to state personnel.
Amend KRS 18A.110 to mandate that the commissioner of the Department of Personnel promulgate administrative regulations for the classified service governing employee evaluations and set regulatory criteria; allow the pay plan for classified employees to authorize performance awards to those individual employees who are employed by federal programs which offer performance incentives; amend KRS 18A.405 to establish the Personnel Pilot Steering Committee within the Department of Personnel and require the Governor to appoint its membership according to specified requirements; amend KRS 18A.410 to require the Personnel Pilot Steering Committee to issue a final report upon the conclusion of individual pilot programs and to make recommendations based upon pilot program experience to the commissioner of the Department of Personnel; delete the provision which required the committee to report quarterly to the LRC's Interim Joint Committee on Appropriations and Revenue stating the amount of money saved by the pilot programs and how the money was or is to be spent; amend 18A.420 and 18A.435 to conform; amend KRS 18A.425 to require agencies participating in the pilot programs to submit semi-annual reports to the Personnel Pilot Steering Committee; require the Personnel Pilot Steering Committee to submit a comprehensive report to the commissioner of the Department of Personnel and the Governor at least sixty (60) days prior to each Regular Session; amend KRS 18A.430 to require a pilot personnel program to expire no later than three (3) years after implementation unless it is extended by administrative regulation; amend KRS 18A.440 to require the Personnel Pilot Steering Committee to consider evidence of support for pilot programs by taking into account surveys performed by a Governmental Services Center; create a new section of KRS 18A to allow the commissioner of Personnel, with the approval of the Personnel Pilot Steering Committee, to extent portions of pilot programs which were developed and approved for the purpose of maintaining a pool of available applicants for social service programs and the alternative classification and pay system until December 15, 1998; pilot programs in effect July 1, 1998 dealing with performance evaluations may continue until January 1, 1999, at which time the performance evaluation system shall be adopted; repeal KRS 18A.112 and KRS 18A.445.
HB 633 - AMENDMENTS
HFA (1, H. Anderson) - Require the Personnel Department to propose, and the Personnel Pilot Steering Committee to approve, a pilot personnel program for collective bargaining.
HFA (2, J. Barrows) - Clarify that performance incentives be paid only from federal funds which are designated for performance incentives and that no state funds shall be used for incentive pay; reinstate the provision which requires the Personnel Pilot Steering Committee to report to the LRC's Interim Joint Committee on Appropriations and Revenue and require the report to include the amount of money saved through the pilot programs; require the Personnel Steering Committee to only report annually to the LRC's Interim Joint Committee on Appropriations and Revenue; require the pilot personnel program to expire no later than three (3) years after implementation unless the expiration date is extended through statute rather than administrative regulation; add the provision that no pilot personnel program proposed after the effective date of this Act shall become effective until the program has been presented for review before the Interim Joint Committee on State Government; extend those portions of pilot programs which deal with performance evaluations until January 1, 2000 at which time the performance evaluation system authorized by this Chapter shall be presented to the General Assembly for consideration for enactment into KRS Chapter 18A.
