HB 649 (BR 2116) - J. Barrows
AN ACT relating to the practice of pharmacy.
Create a new section of KRS Chapter 315 to require the Board of Pharmacy to establish an impaired pharmacist committee; permit the board to contract for the creation of the committee; authorize the board to promulgate administrative regulations to implement the provision of this section; require the board to collect an additional $10 for licensure fees for the operation of the committee; exempt committee members from liability for any claim or damages brought as a result of "good faith" committee actions; require the committee to keep all information collected during investigations confidential; require the committee to keep all records and proceedings confidential, not subject to subpoena or not considered public record; permits the committee to disclose confidential information for treatment purposes, or authorization of the pharmacist, or subject to requirements of KRS 315.121 that covers the release of confidential information in potentially harmful situations; amend KRS 333.040 to exempt medical laboratories operated by facilities holding a permit pursuant to KRS 315.035 and a valid certification pursuant to the Clinical Laboratory Improvement Act of 1988, from provisions of KRS Chapter 333, relating to medical laboratories, only in connection with testing or treatment of their own patients; amend KRS 315.010 to make technical correction changing the requirement from 15 to 1-1/2 continuing education units per year.
HB 649 - AMENDMENTS
HFA (1, R. Damron) - Create a new section of KRS 315 relating to pharmacists' and pharmacies' ability to place certain drugs in home health agencies and hospices; require written agreement between the pharmacy and the home health agency or hospice; require the development of a written protocol on drug storage and handling; require the pharmacist in charge to conduct quarterly inventory and inspection reviews; require the cabinet to promulgate administrative regulations to implement these provision.
SCS - Modify the regulatory exemption for medical laboratories operated by facilities to relate to certain tests available from stock or inventory and used in connection with treatment covered under collaborative care agreements; add glucagon, influenza vaccine, and pneumonia vaccine to the list of drugs a home health agency may maintain with a written agreement with a pharmacy; require a facility inspection at least once per year; retain all other provisions of HB 649/GA.
SFA (1, W. Blevins) - Amend to require each pharmacist to dispense generic or brandname prescription drugs, whichever is the lower cost to the purchaser.
