HB 655 (BR 931) - P. Worthington

     AN ACT relating to the six (6) year road plan.
     Amend KRS 176.419 to define "six year road plan" and "statewide transportation plan"; amend KRS 176.420, to require the department of highways to submit the six year road plan at the same time, rather than within 10 working days of when, the Governor submits the executive branch budget to the General Assembly; specify information to be included in the plan; require the department of highways to also submit the statewide transportation plan to the General Assembly at the time the road plan is submitted; amend KRS 176.430 to allow projects in the fund scheduled to be funded in the ensuing biennium to exceed the budget by 10% of the first year of the biennium, but prohibit the projects from exceeding the budget the second year of the biennium; specify information the Transportation Cabinet is to submit to the legislature on six-year road plan projects; amend KRS 176.440 to delete requirement for the Transportation Cabinet to submit a draft plan six (6) months preceding a regular session of the General Assembly; amend KRS 45.245, 45.246, and 45.247 to conform; repeal KRS 45.2451, 45.248, 176.435, 176.460, and 176.470.

HB 655 - AMENDMENTS


     SCS - Retain provisions of the house bill with the following exceptions: include "estimated cost to complete a project" as a component of the six year road plan; add a section to the six year road plan presented to the General Assembly that provides a list of projects from the last four years of the plan, not to exceed 10% of estimated biennial appropriation, for potential acceleration if more funds are received or projects are delayed; delete all references to "statewide transportation plan"; eliminate requirement that governor present the six year road plan to the General Assembly at the same time as he submits the budget; delete all references to over programming projects by 10%; require the Transportation Cabinet to develop, in addition to the potential acceleration list submitted with the six year road plan, a second list of projects from the last four years of the plan, not to exceed 10% of the actual biennial appropriation, for potential acceleration if more funds are received or projects are delayed; require that this second list and any project from either acceleration list that is advanced be reported to the LRC; require the state highway engineer to provide a cost estimate by January 15 for any project requested for advancement or inclusion in the six year road plan by a member of the General Assembly if the request is received by November 1 of the preceding year; require General Assembly amendments to the six year road plan to use cost estimates provided by the state highway engineer.
