HB 704 (BR 393) - R. Damron

     AN ACT relating to lease of real property for state use.
     Amend KRS 48.111 to require that the Capital Projects and Bond Oversight Committee review certain leases, not listed in the budget, before advertisements are placed for the leases; amend KRS 56.803 to require the commissioner of the Department for Facilities Management, certain department employees and the head of the agency that will occupy leased space to certify that the lease process did not violate KRS 56.800 to 56.823; amend KRS 56.814 to prohibit state employees from discussing leasing plans with landlords outside of the lease process; amend KRS 56.823 to require that all leases, including all lease renewals, with annual rental in excess of $100,000 be reported to the Capital Projects and Bond Oversight Committee; amend KRS 56.990 to create penalties for violations of KRS 56.800 to 56.823; amend KRS 56.805 to conform.

HB 704 - AMENDMENTS


     HCS - Change the timing of the Capital Projects and Bond Oversight Committee's review of certain state leases from before advertisement to prior to final authorization; refine other language.
     SFA (1, A. Robinson) - Permit proposed new construction to be considered in state procurement of leased office space without going through the built-to-suit process, so long as the proposed new construction does not contain provision for a lease-purchase or an option to purchase.
