HB 728 (BR 2284) - Ro. Adams, P. Clark, J. Coleman, B. Colter, D. Horlander, E. Jordan, R. Murgatroyd, R. Palumbo, M. Weaver

     AN ACT relating to alcoholic beverages.
     Create new sections of KRS Chapter 244 to require any person selling alcoholic beverages to obtain proof of age from a prospective buyer or recipient whom the seller believes is under the age of 21; require that the owner of a retail establishment that sells alcoholic beverages notify his or her employees that the sale and purchase of alcoholic beverages to those under 21 are prohibited and that proof of age is required from those believed to be under 21; require the board to conduct random searches of retail establishments and permit the use of minors under 18 to determine compliance if done so under the direct supervision of the board, sheriff, or chief of police or their employees and parental consent is given.

HB 728 - AMENDMENTS


     HFA (1, R. Adams) - Delete provision permitting persons under 18 to participate in investigations to determine whether alcoholic beverages are being sold to underage drinkers if they are supervised and parental permission is given.
     HFA (2, F. Nesler) - Retain the original provisions of the bill with the following changes: add a new Section 4 to amend KRS 244.085 to require any person under the age of 21 who attempts to purchase alcoholic beverages, or uses a fake i.d. to attempt to purchase alcohol, or any person who assists a minor in the purchase of alcohol to be subject to the suspension or revocation of their driver's license in addition to other penalties provided by statute; add a new Section 5 amending KRS 186.560 to conform; renumber existing Section 4 as Section 6.
     SFA (1, B. Metcalf) - Set out instruments that may be used to verify one's age when purchasing alcoholic beverages to include an unexpired driver's license, a nondriver identification card, an Armed Forces identification card, and an unexpired passport.
     SFA (2, D. Seum) - Specify that "services" include any manpower or labor provided by a brewer or distributor to a retailer.
     SFA (3, D. Seum) - Prohibit a brewer of distributor from providing free labor to induce a malt beverage retailer to buy the brewer's or distributor's malt beverage.
