AN ACT authorizing municipalities to enact and enforce juvenile curfew ordinances.
Create new sections of KRS Chapter 82 to define "juvenile" as any person under the age of eighteen (18); allow cities to enact and enforce an ordinance establishing a juvenile curfew; require juvenile curfew ordinance to clearly establish terms of curfew code; include exceptions in ordinance to permit juveniles to exercise constitutionally protected rights; specify that the curfew ordinance shall not authorize a police officer to detain a juvenile for any period longer than necessary to issue a warning citation; prohibit a juvenile curfew ordinance from imposing a penalty on a juvenile who has committed a violation of a juvenile curfew ordinance; allow juvenile curfew ordinance to provide that upon the issuance of a third or subsequent warning citation to a juvenile for a violation of the ordinance a status offense complaint may be filed; allow juvenile curfew ordinance to make it unlawful for a parent to permit or allow a juvenile to violate the ordinance; provide that the ordinance may establish penalties on a parent found in violation of the ordinance; amend KRS 600.020 to conform.
