AN ACT relating to liens.
Create a new section of KRS Chapter 376 to require certain information when a lien is filed; create a new section of KRS Chapter 376 to provide for the speedy removal of a false lien and provide for a civil action against the filer of the lien; create a new section of KRS Chapter 434 to create the offense of filing a false lien which is a Class D felony for the first offense, Class C felony for a second offense, and Class B felony for a third or subsequent offense.
HB 794 - AMENDMENTS
HCS/CI - Change the elements of the offense of filing an illegal lien from the defendant "should have known" to the defendant "knew" that the lien was illegal.
HFA (1, R. Wilkey) - Lower the criminal penalties for filing an illegal lien.
