AN ACT relating to crimes and punishments.
     Amend KRS 237.010 relating to definitions for destructive devices to include a simulated destructive device which is any device that imitates a destructive device, such as a fake hand grenade; amend KRS 237.040 relating to criminal possession of a destructive device to change intent from "intent" to use to "the capacity to use" and to remove provision stating "mere possession without substantial evidence of the requisite intent is insufficient to bring action under KRS 237.030 to 237.050; amend KRS 237.050 relating to exemptions from destructive device statutes to include simulated destructive devices and replace provision that inert devices which cannot readily be restored to operation are legal with a provision requiring that the device cannot be restored to operation, permit possession of destructive devices by "authorized agents" of government; amend KRS 237.990 relating to penalties for destructive devices, including possession of simulated destructive device, to increase penalty from Class D to Class C felony.
