HB 920 (BR 2495) - C. Ratliff

     AN ACT relating to school property.
     Create a new section of KRS Chapter 160 relating to the disposal of real and personal property declared surplus to the educational needs of the local school district; require the request for approval to dispose of real property be submitted to the Commissioner of Education; require the local board of education to set the price of the property based on the fair market value as determined by a certified appraiser, advertise the property for sale under KRS 424.130(c), and dispose of the property by public auction or by accepting sealed bids; prohibit a business from bidding on real property under this section if a school board member, a school board employee, or a relative of a school board member or school board employee has at least 5% interest or an investment of at least $10,000 in the business; prohibit a school board member, a school board employee, or a relative of a school board member or a school board employee from bidding on real property under this section; require the school board to hold a public hearing before the sale of real property to determine the intended use of that property; require the board's attorney certify that the requirements of all statutes have been met relative to the sale; amend KRS 156.160 to conform; amend KRS 160.990 to stipulate that any business or individual that violates the provisions of subsection (4) of Section 1 of this Act shall be guilty of a Class A misdemeanor.
