SB 119/CI (BR 1403) - E. Harris

     AN ACT relating to unlawful telecommunications devices.
     Create a new section of KRS Chapter 514 to prohibit manufacturing, possessing, and various other acts relating to devices for theft of telecommunications service; repeal KRS 514.065 relating to the same topic.

SB 119 - AMENDMENTS


     SCS/CI - Amend KRS 514.060 to prohibit the theft of wireless communications services, and require restitution to service providers; create a civil cause of action for damages; provide for injunctive relief, and provide for recovery of litigation expenses; amend KRS 514.065 to specify the types of actions which shall constitute the theft of telecommunications services, and provide for restitution to service providers; create a civil cause of action for damages,as well as injunctive relief, provide for recovery of litigation expenses; and provide for seizure and destruction of prohibited devices.
     SCA (1, E. Harris) - Make title amendment.
     HCS/CI - Delete provisions relating to restitution and civil remedies for violation of statute, retain criminal provisions.
