SB 133 (BR 1499) - T. Buford

     AN ACT relating to school employees.
     Establish a new section of KRS 161.730 to 161.810 to require that all references to allegations or findings in an investigation that a teacher, administrator, or other school employee acted improperly relating to the statewide assessment program that occurred before the effective date of this act be expunged from the individual's personnel file in the local district and references to the case be removed from agency files retained by the Kentucky Department of Education and the Kentucky Education Professional Standards Board; require that allegations made after July 15, 1998 be investigated but if an individual is found not guilty that all references to the charges be expunged from the individual's personnel file and agency files of the Kentucky Department of Education and the Education Professional Standards Board and if the individual is found guilty that all records be expunged after nine (9) months from the date the judgment was rendered in the investigation; and amend KRS 161. 120 to exempt improper behavior relating to the statewide assessment program as a reason for certificate revocation.

SB 133 - AMENDMENTS


     SCS - Retain original provisions but apply the expungement of teachers' files apply to persons found not guilty of the allegations of improper actions relating to the statewide assessment program; delete provisions requiring that all records be expunged after nine months from the date the judgment was rendered in the investigation; delete the provision exempting improper behavior as a reason for certificate revocation.
     HFA (1, J. Gooch) - Attach provision of HB 522 to provide that a classified employee be on the superintendent's screening committee.
     HFA (2, D. Butler) - Provide that employees of a local board may report a student for investigation to the director of pupil personnel if an agreement has been entered into with local law enforcement officials and describe the components of procedures to be addressed in the agreement.
