     AN ACT relating to traumatic brain injury.
     Create new sections of KRS Chapter 211 to define terms, establish the Kentucky Traumatic Brain Injury Trust Fund Board and to set forth its operating parameters and duties; create a new section of KRS Chapter 211 to establish the traumatic brain injury trust fund and to establish criteria for expenditures from the fund; amend KRS 189.990 to impose an additional fee of $5 against certain moving violations to be deposited in the trust fund; amend KRS 189.390 to impose an additional fee of $10 against speeding violations to be deposited in the trust fund; and amend KRS 189A.010 to impose an additional fee of $15 against individuals convicted of DUI to be deposited in the trust fund; amend KRS 186.574 to conform.

SB 145 - AMENDMENTS


     SCS - Retain original provisions except delete from membership on the Kentucky Traumatic Brain Injury Trust Fund Board the Director of the Kentucky Injury Prevention and Research Center and replace that entity with the state medical epidemiologist; limit the data reported by hospitals to the Cabinet for Human Resources; limit trust fund expenditures for the medical registry to $125,000 for any fiscal year; limit administrative costs of the Trust Fund Board to 3 percent of the trust fund proceeds.
     SFA (1, J. Pendleton) - Delete exemption of Traumatic Brain Injury Trust Fund Board members from any personal liability or accountability for any loss sustained on account of any action or inaction of the board; increase assessment on driving under the influence offenses from $15 to $20; increase from $5 to $10 the fine imposed against selected moving violations.
