     AN ACT relating to access to health care by children.
     Amend KRS 304.17A.-160 to require one of the five standard health benefit plans to be a children's preventive health services benefit plan; create new sections of Subtitle 17A of KRS Chapter 304 to establish the Kentucky Healthy Children's Program and Foundation; create a 15 member board of directors for the program and foundation; provide for method of appointment and terms of office; set forth functions of the program and foundation including administering any funds appropriated and any gifts or donations received for the purposes of improving access to preventive health services by children, administering any savings from the implementation of the approved Section 1115 of the federal Social Security Act waiver program establishing capitated managed care for Medicaid recipients, making health benefit plan premium payments under the children's preventive health services benefit plan and limited to children under age 18 in families with incomes below 250 percent of federal poverty guidelines and without insurance coverage and not enrolled in the Medicaid program, and facilitating collaboration among state-funded non-Medicaid preventive health programs for children; require the program and foundation to recommend a specified basic benefit package for adoption as the children's preventive health services benefit plan; direct the federal Health Care Financing Administration be requested to modify its approved Medicaid managed care waiver to permit extension of Medicaid coverage for a preventive health services package for children in families with incomes below 250 percent of the federal poverty level guidelines and which is comparable to the recommended children's preventive health services benefit plan.
