AN ACT relating to education assessment and accountability and declaring an emergency.
Create a new section of KRS Chapter 158 to define terms; require the Department of Education to develop an implementation plan for assessment and accountability addressing specified components and make quarterly reports to the Interim Joint Committee on Education; establish the State Advisory Committee for Educational Improvement with 18 members appointed by the Governor to advise on the implementation of the assessment and accountability system and to assist the Kentucky Board of Education in planning and implementing the Commonwealth School Improvement Fund program; amend KRS 156.160 to require the state board to identify the common content for the different grades and subjects in the Program of Studies and to distribute the Program of Studies to schools and school districts; require that student scores from any assessment that is reliable at the individual student level be included on the student transcript; amend 158.6453 to require that the assessment program include a standardized national norm-referenced test that provides normative data reliable for individual students, open-response and multiple-choice items in reading mathematics, writing, science, social studies, arts and humanities, and practical living and vocational studies derived from core content with significant Kentucky teacher involvement, writing portfolios in grades 4, 7, and 12, and a technically sound longitudinal comparison of the assessment results for the same students; require the assessments to be designed to measure core academic content, basic skills, and higher-order skills, provide valid and reliable scores for schools and for students when scores are reported for students individually, minimize the time spent by teachers and students on testing; require the reporting of results as soon as practicable; require a biennial plan for validation studies with reports to the Interim Joint Committee on Education; require district continuous assessments to provide diagnostic information to improve instruction; require the Kentucky Board of Education to establish the components of a school report card that include measures of academic achievement, nonacademic achievement, and school climate, including parent involvement; amend KRS 158.6455 to distribute rewards to the school council based on the number of staff assigned to the school to be used for school purposes when the school exceeds its threshold for improvement; classify schools every two years beginning with the 2000-2002 cycle with the 1998-1999 and 1999-2000 school years serving as the baseline; require the distinguished education personnel evaluation process in a "school in crisis" to continue until the employee receives a satisfactory evaluation or the school classification changes whichever occurs first; require an independent team to review any school with an accountability index ranking in the top 10% of the schools in the state prior to being classified a "school in crisis;" classify the school "in decline" if the classification is not appropriate; require the team to recommend whether a distinguished educator should be assigned to the school, and eliminate the school's eligibility for school improvement funds; allocate district rewards to be used for purposes determined by the local board of education; amend KRS 158.805 and 158.782 to conform; require the Kentucky Board of Education and the Department of Education to administer the KIRIS tests in the 1997-98 school year in the grades and subjects as designed and a national, commercially-available norm-referenced test selected by the state board to all students beginning at the end of primary to grade 12, except grade 11; allow a district to be reimbursed if it plans to or has administered the selected test to all students; require the Kentucky Board of Education to remove the Accountability Cycle Two determination for each school; authorize a school improvement award to every school in 1997-98 from the Kentucky successful schools fund and prohibit distribution of school rewards based on Accountability Cycle Three results; permit a school "in decline: or a "school in crisis" to retain the assistance of the Distinguished Educator who may act only in an advisory capacity; offer every school that would have been determined "in decline" or "in crisis" for Accountability Cycle Three the assistance of a distinguished educator and permit the schools to apply for Commonwealth School Improvement Funds; EMERGENCY.
SB 243 - AMENDMENTS
SCS - Create a new section of KRS Chapter 158 to define terms; amend KRS 7.410 to require the Office of Education Accountability to monitor and make recommendations concerning the assessment and accountability program; require the office to respond to issues submitted for its approval by the Commissioner of Education within 30 days; amend KRS 156.160 to require the Kentucky Board of Education to revise the program of studies to identify the common curriculum content tied to the goals, outcomes, and assessment program and require distribution to schools and districts; include on the student transcript assessment scores that are valid and reliable, as determined by the Office of Education Accountability; amend KRS 156.6453 to require the Department of Education to receive approval from the Office of Education Accountability prior to submitting changes to the new assessment system to the Kentucky Board of Education; include as components in the assessment program a standardized national norm-referenced test that provides valid and reliable results for individual students, open-response or multiple-choice items, or both, to assess student skills in reading, mathematics, writing, science, social studies, visual arts and humanities, practical living and vocational studies, and writing portfolios consisting of samples of student work; performance assessment events for schools that have students enrolled in performing arts organizations sponsoring sanctioned events with an established protocol for adjudication; and a technically sound longitudinal comparison of the assessment results for the same students; require Kentucky teachers to have a significant role in the development of the new assessments; require the assessments to measure core academic content, basic skills, and higher order skills that are grade appropriate; to provide valid and reliable school scores; and to minimize the time spent on assessment by teachers and students; require that any scores reported for individual students be valid and reliable; require the department to establish a plan for validation studies, including the relationship between the state assessment results and other indicators of improved academic achievement by students and the accuracy of school classifications; require the Kentucky Board of Education to establish the components of a school report card, including factors related to student academic achievement, nonacademic achievement, and the school learning environment; amend KRS 158.6455 to delete existing requirements concerning the accountability system, rewards, and consequences; require the Department of Education to receive approval from the Office of Education Accountability prior to the Kentucky Board of Education adopting a new formula for the school accountability index and rewards and sanctions; exclude portfolios from the computation of an accountability index; amend KRS 158.782, to eliminate all the powers and duties of the distinguished educators and the recognition component of the program; require the Department of Education to receive approval from the Office of Education Accountability prior to adopting administrative regulations for providing highly skilled education assistance to school districts; amend KRS 156.132 and KRS 158.805 to conform; require the Department of Education to administer the 1997-98 KIRIS assessment as designed for information purposes; administer a national, commercially-available norm-referenced test selected by the Kentucky Board of Education to all students beginning at the end of the primary program, except students in grade eleven (11), in reading, writing, mathematics, science, or social studies, if KIRIS does not test the subject area at the grade level; reimburse school districts that have administered or plan to administer the selected test during the 1997-98 school year; prohibit the Kentucky Board of Education from making a determination of school success, dispensing rewards, or applying sanctions to schools or districts based on any assessment administered during the 1996-1998 biennium; void all school classifications based on data obtained prior to the 1998-99 school year; prohibit the use of academic assessment data from school years prior to 1998-99 in the new assessment and accountability system; permit a distinguished educator assigned to a school during the 1997-98 school year to continue in an advisory capacity until the end of the school year; offer schools that were "in decline" or "in crisis" during the 1996-98 biennium highly skilled education assistance and allow them to apply for Commonwealth school improvement funds; distribute a school improvement award to every school in 1997-98; EMERGENCY.
SFA (1, N. Kafoglis) - Require both open-response and multiple choice items in the student assessment.

Kafoglis) - Create a new section of KRS Chapter 158 to establish the School Curriculum, Assessment, and Accountability Council, composed of 15 members to advise the Kentucky Board of Education and the Legislative Research Commission on all issues related to developing and communicating academic expectations and core content for assessment in the development and implementation of the statewide assessment and accountability program; amend sections to conform.
SFA (3, N. Kafoglis) - Direct the Kentucky Board of Education to establish baselines and thresholds for school improvement and distribute rewards at the end of Accountability Cycle Three, using academic and nonacademic components that were consistent during the four-year period.
SFA (4, N. Kafoglis) - Create a new section of KRS Chapter 158 to establish the School Curriculum, Assessment, and Accountability Council, composed of 15 members to advise the Kentucky Board of Education and the Legislative Research Commission on all issues related to developing and communicating academic expectations and core content for assessment in the development and implementation of the statewide assessment and accountability program; remove specific approval authority over the assessment and accountability system from the Office of Education Accountability; amend sections to conform.
SFA (5, N. Kafoglis) - Delete the requirement that portfolio scores not be included in the accountability formula.
SFA (6, N. Kafoglis) - Direct the Kentucky Board of Education to distribute awards at the end of Accountability Cycle Three to each school that exceeds its baseline and to award each school that exceeds its threshold twice that amount.
SFA (7, E. Harris) - Require results from the state assessment be reported to school districts and schools no later than September 15 of the following school year.
SFA (8, T. Shaughnessy) - Delete title of the assessment and accountability program; make technical correction.
SFA (9, L. Casebier) - Require testing of the arts and the humanities, as opposed to the visual arts and humanities.
SFA (10, D. Karem) - Permit schools that have been granted an exemption from implementing school-based decision making based on performing above their school thresholds to retain their exemption until the next accountability determination.
