SB 303 (BR 2075) - K. Nelson, W. Blevins, P. Herron Jr, E. Scorsone

     AN ACT relating to classified employees in local school districts and declaring an emergency.
     Amend KRS 161.011 to define seniority as the total months of service in a specific classified position, including all approved paid and unpaid leave; require local districts to enter into annual written contracts with classified employees; require that effective July 12, 1998, a classified employee who completes four (4) successive years of employment and has satisfactory evaluations shall be granted a continuing contract; require that any classified employee who at the effective date of this Act has completed four or more years of employment in the district be granted a continuing contract; require that limited status employees who are not rehired shall be notified in writing no later than May 30 of each year; require that if a reduction in force occurs due lack of funds, consolidation of schools, or other compelling reasons, limited status employees shall be laid off before any continuing status employees, and seniority shall be considered in both layoffs and reemployment of laid off employees; provide that a continuing status employee may be terminated for unsatisfactory job performance which shall be documented through an evaluation process.

     SFA (3, K. Nelson) - Define seniority as total months of continuous service in a local school district including all approved paid and unpaid leave; provide that all classified employees will receive an annual contract except employees who have less than four years service credit who are notified by April 30 that their contract will not be renewed and allow the nonrenewed employees to request reasons and employees with four or more years service credit in the district and who have received notification by April 30 that their contracts are not being renewed for cause and allow them to request all of the facts; provide that superintendents can have a staff reduction for cause; provide that reductions shall be based on seniority and qualifications; and provide that recall to positions shall be based on seniority and qualifications; make technical changes to conform.
     HCS - Retain original provisions; require that reductions of employees shall be based upon seniority and qualifications within each job classification affected.
     HFA (1, D. Butler) - Provide that classified employees of a local board may report a student for investigation to the director of pupil personnel if an agreement has been entered into with local law enforcement officials and describe the components of procedures to be addressed in the agreement.
