SB 326 (BR 41) - D. Williams

     AN ACT relating to county judges/executive.
     Amend KRS 67.705 to require the Governor to fill a vacancy in the office of county judge/executive not later than 10 days after the date the vacancy occurs and to require the remaining fiscal court members to elect one of their members to serve as temporary judge/executive until the Governor appoints a replacement, notwithstanding the provisions of KRS 67.080(2) concerning incompatible county offices to the contrary.

SB 326 - AMENDMENTS


     HCS - Change from ten days to thirty days the amount of time in which the Governor must fill a vacancy in the office of a county judge/executive.
     HFA (1, J. Clarke) - Create the Interim Commission to Study County Government to review the structure and function of all Kentucky counties and to report to the Legislative Research Commission the status of the counties in that regard, which may include a plan to reduce the number of counties in Kentucky; establish commission membership; establish commission pay, meeting provisions, reporting provisions, and length of terms of membership.
     HFA (2/Title, J. Clarke) - Make title amendment.
     HFA (3, J. Zimmerman) - Create the Interim Commission to Study County Government to review the structure and function of all Kentucky counties and to report to the Legislative Research Commission the status of the counties in that regard, which may include a plan to reduce the number of counties in Kentucky; and establish commission membership, members' terms, pay, meeting provisions, and reporting provisions.
     HFA (4, J. Zimmerman) - Create the Interim Commission to Study County Government to review the structure and function of all Kentucky counties and to report to the Legislative Research Commission the status of the counties in that regard, which may include a plan to reduce the number of counties in Kentucky; establish commission membership, members' terms, pay, meeting provisions, and reporting provisions.
     CCR - Report that the Conference Committee could not agree and request that a Free Conference Committee be appointed.
     FCCR (Majority Report) - Adopt original provisions of SB 326/HCS; require the Interim Joint Committee on State Government, by means of a 27-member task force comprised of legislators, local government officials, area development officials, and the commissioner of the Department for Local Government, to review the organization, structure, and function of local government and report its recommendations to the Legislative Research Commission by September 1, 1999; amend the title to conform with the addition of the study language. (Majority report).
     FCCR (Minority Report) - Adopt original provisions of SB 326/HCS specifying that the Governor is required to appoint a person to fill the vacancy in the office of county judge/executive not more than 30 days, instead of 10 days, after the vacancy occurs (minority report).
