SB 328 (BR 1906) - E. Rose

     AN ACT relating to critical access hospitals.
     Create various new sections of KRS Chapter 216 to define terms including "rural health network" and "secretary"; direct the Cabinet for Human Resources to make application to the Secretary of the United States Department of Health and Human Services to establish a Medicare rural hospital flexibility program; require the cabinet to develop and submit with the application a Rural Health Plan; amend KRS 216.380 to delete references to "rural primary care hospital" and replace it with "critical access hospital"; add criteria for relicensure of a general acute-care hospital as a critical access hospital; set forth services required to be provided by a critical access hospital instead of by a rural primary care hospital; set forth staffing plan requirements for a critical access hospital; provide for specified agreements for patient referral and transfer and credentialing and quality assurance when a critical access hospital is part of a rural health network.

SB 328 - AMENDMENTS


     SCA (1, J. Pendleton) - Require a certificate of need to be obtained for nursing facility beds in an acute-care hospital converting to a critical access hospital; require swing beds or a distinct unit of the hospital which is a nursing facility in a critical access hospital to be subject to approval under certificate of need.
     SFA (2, J. Rose) - Retain original provisions except delete home health agency exemption from obtaining certificate of need.
     HCS - Retain original provisions except create a new section of KRS Chapter 216 to allow hospitals located in a hospital district pursuant to KRS 216.310 to 216.360 to offer specified services and facilities in counties contiguous to the hospital district and obtain a certificate of need where required.
     HCA (1, J. Gooch) - Make title amendment.
     HFA (1, P. Mason) - Delete mandate for Cabinet for Human Resources to seek a federal Medicaid waiver to permit cost-based reimbursement of services provided to Medicaid recipients in a critical access hospital and instead require the Cabinet to provide for reimbursement for the services.
     HFA (2, P. Mason) - Require a certificate of need be obtained prior to critical access hospital provision of home health services.
     HFA (3, P. Mason) - Require a certificate of need approval for a critical access hospital to provide swing beds or a distinct unit of a hospital which is a nursing facility in accordance with KRS Chapter 216B; restore original language, which had been deleted from KRS 216.380 (5)(a), which allows for swing beds or a distinct nursing facility only if there is not a bed available in any nursing facility, intermediate care facility, or skilled nursing facility within the county of residence of the patient or of the hospital, or that the patient has been refused admission to the nursing facility, intermediate care facility, or skilled nursing facility.
     HFA (4, P. Mason) - Require swing beds or a distinct unit of a critical access hospital which is a nursing facility to be subject to approval under certificate of need.
     HFA (5, J. Hoover) - Amend to waive issuance of a certificate of need for the relocation of hospital administrative or outpatient services which are on the premises of a hospital or for performing selected on-site services.
