SB 36/CI (BR 485) - E. Scorsone, D. Boswell, D. Seum

     AN ACT relating to protection of adults.
     Amend KRS 209.990, relating to penalties for violations of offenses relating to adult abuse and exploitation and protection of adults, to change elements of the offense from "knowingly and willfully" to "knowingly or wantonly" thus matching penal code definitions, and to create a separate Class D felony offense for exploitation of an adult, unless the offense is financial in nature and the amount of the total loss from the offense is less than $300, in which case it is a Class A misdemeanor.

SB 36 - AMENDMENTS


     SCS/CI - Amend KRS 209.990 to make abusing or neglecting an adult knowingly a class C felony; wantonly abusing or neglecting an adult a class D felony; recklessly abusing or neglecting adult a class A misdemeanor; to make exploiting an adult knowingly a class C felony, when the exploitation amounts to more than three hundred dollars; exploiting an adult wantonly or recklessly a class D felony, when the exploitation amounts to more than three hundred dollars; and to make exploiting an adult knowingly, wantonly, or recklessly a class A misdemeanor, when the exploitation amounts to three hundred dollars or less.
