SB 364 (BR 2521) - C. Borders

     AN ACT relating to environmental protection.
     Amend KRS 224.01-400 which requires the characterization of releases of hazardous substances, to add factors to be considered by the cabinet in assessing if restoration without removal will be allowed, for example, the current and future use for the site.

SB 364 - AMENDMENTS


     SFA (1, C. Borders) - Delete references to the public welfare and employment opportunities.
     HFA (1, G. Stumbo) - Amend KRS 224.01-400 to allow the use of existing or proposed engineering or institutional controls to manage the release of a hazardous substance; remove land use restrictions as a means; remove engineering or institutional controls and land use restrictions from list of factors used to demonstrate effectiveness of remedy when hazardous substance is not removed.
