SB 399 (BR 2257) - D. Karem, T. Buford

     AN ACT relating to highways.
     Create various new sections of KRS Chapter 177, relating to state and federal highways, to define "advertising device", "archaeological quality", "cultural quality", "historic quality", "intrinsic quality", "natural quality", "outdoor advertising device", "recreational quality", "scenic byway", "scenic highway", and "scenic quality"; require the Transportation Cabinet to coordinate with the Tourism Development Cabinet and the Kentucky Heritage Council to develop criteria for designating roads as scenic byways; require the Transportation to hold pubic meetings when proposing to alter or improve a scenic byway; prohibit billboards from being erected along a scenic byway; encourage local governments affected by a scenic byway to develop a plan to preserve the intrinsic qualities of the road; grandfather under the provisions of this Act all roads currently designated as scenic byways.

SB 399 - AMENDMENTS


     SCS - Retain the provisions of the original bill, with the following changes: In Section 5 clarify procedures the Transportation Cabinet must follow when proposing to alter or improve a state-maintained road designated as a scenic highway; in Section 6 clarify the types of outdoor advertising devices prohibited from being erected adjacent to, or visible from, a scenic highway.
     SCA (1, R. Sanders Jr) - Amend Section 7 of the committee substitute to require the Transportation Cabinet to remove the scenic designation of KY 101 and KY 259 in Edmonson County upon the effective date of this Act.
     HCS - Retain the original provisions of the bill with the following changes in Section 5; delete subsections (4) through (8) in their entirety.
