AN ACT relating to charter buses.
Amend KRS 281.013 and 281.605 to define and deregulate charter buses; repeal KRS 281.637.
SB 440 - AMENDMENTS
SFA (1, J. Rose) - Retain original provisions, except undo repeal of KRS 281.637 relating to certificate of need procedures; exempt charter bus companies domiciled in Kentucky from having to apply for a charter bus certificate; define an irregular route common carrier as engaged in interstate commerce only.
SFA (2, J. Rose) - Retain original provisions, except require charter bus companies operating in Kentucky to meet federal standards of fitness and safety.
HFA (1, D. Butler) - Amend Section 3 to require the Department for Vehicle Regulation to establish an annual inspection system for intrastate charter buses, set fee for inspection at not more than $100, require charter bus engaged in intrastate service to bear sicker signifying compliance with inspection program.
HFA (2, D. Butler) - Amend Section 3 to require all charter buses operating in the Commonwealth to undergo an annual visual safety inspection; allow the Transportation Cabinet to promulgate administrative regulations to establish a fee, not to exceed $100, to offset the cabinet's cost of the inspection.
HFA (3, M. Weaver) - Amend Section 3 to require all charter buses to undergo an annual state inspection; allow the cabinet to establish a fee not to exceed $100 to cover the administrative costs of the inspection; establish a $500 fine per bus for any person who willfully avoids the safety inspection.
