AN ACT relating to environmental responsibility for waste management.
Create a new section of KRS 224 to define a large-scale swine feeding operation as an any operation with over one thousand swine units; provide a formula for calculating swine units; for the purposes of determining whether a swine feeding operation is large-scale and required to obtain a permit or authorization, require the cabinet to consider and aggregate all swine units located within the Commonwealth which are owned or controlled by a corporation or other business association; require the applicant to demonstrate financial responsibility for closure of the operation; prohibit any large-scale swine feeding operation from being located in a 100-year floodplain unless precautions are employed to flood-proof; in approving a swine feeding operation, require the cabinet to assess the cumulative effects of the operations based on its surroundings; prohibit any new manure or wastewater facility at a new or expanded swine feeding operation from being a nuisance.
