SB 71 (BR 1371) - E. Scorsone

     AN ACT relating to school safety.
     Create new sections of KRS Chapter 158 to require the Kentucky Department of Education to develop and evaluate training materials and guidelines on school safety issues; provide that the department establish and administer a grant program for the purpose of developing innovative programs of violence prevention, conflict resolution, and other related programs; provide that the department conduct a study of the issue of school security including two-way communications, classroom security, and measures to assure the safety of teachers, students, and other school employees; amend KRS 158.148 to provide that the Kentucky Department of Education develop statewide student discipline guidelines, recommendations to improve the learning environment, and student achievement and to reduce the dropout rate; amend KRS 158.148 to provide that each local district develop a code of acceptable behavior and discipline and provide specific requirements that shall be included in the code, including a immediate intervention for any student possessing a weapon, using any object or weapon in a threatening manner, using or possessing any narcotic or stimulant drug, engaging in any physical assault, or threatening bodily harm; require that each district have a discipline review committee; provide for the alternative placement of students for disruptive, threatening, or violent students; and amend KRS 610.345 to include procedures for disclosing information about a child who is found guilty of certain offenses.

SB 71 - AMENDMENTS


     SCS - Create new sections of KRS Chapter 158 to state the findings of the General Assembly, to define terms, and establish a Center for School Safety as the central contact for school safety research, program development, and technical assistance; establish a board of directors appointed by the Governor, by July 15, 1998, with representation from state agencies and education advocacy groups; establish responsibilities of the board of directors, including the selection of a university site for the center, by January 1,1999, and provide a four-year contract for operating the center; assign duties to the Department of Education and the Kentucky Board of Education relating to safety, discipline and such related matters as data collection, promulgating administrative regulations, and determining criteria and selecting school districts to receive grants; require each local school district to complete an assessment of school safety and discipline during 1998-99, and to develop a strategic plan by May 15, 1999, involving community representatives in the development, including representatives from juvenile delinquency prevention councils, if available; establish a grant program to assist local school districts in the development of alternative programs and innovative programs addressing school safety issues; provide that the grant application and funding process in 1999-2000 and in subsequent years shall be under the direction of the Center for School Safety; create a new section of KRS Chapter 605 to direct the Department of Juvenile Justice to provide a day treatment program that is accessible to every school district in each judicial district; amend KRS 12.020 to attach the board of directors for the Center for School Safety to the Education, Arts, and Humanities Cabinet; amend KRS 158.148 to modify language relating to student guidelines, and the roles of the Department of Education, the Center for School Safety and the school council; amend KRS 158.150 to provide for disciplinary actions, including expulsion, for certain offenses, and require school districts to provide educational and intervention services in an appropriate alternative program or setting to any student who is expelled from school; permit a threatening student to be immediately removed by a teacher, administrator or other school personnel; require a principal to report to local law enforcement certain acts or offenses believed to have occurred on school property; amend KRS 160.345 to require the school council to select and implement discipline as a part of a comprehensive school safety plan; amend KRS 160.320 and 160.340 requiring student adjudication records be made available to transportation personnel; amend KRS 610.345 to provide the notice of adjudication be released to school representatives having responsibility for classroom instruction of the child and to school districts concerning violent offenders within five (5) days of the court's findings; EMERGENCY.
     SCA (2, R. Stivers) - Require that grants be awarded for implementing proven programs, as opposed to developing innovative programs; require the district code allow persons lawfully on school property to defend themselves from attack by lawful means; require the courts to notify the principal of the charge, the adjudication, and the disposition of a case when a petition is filed or a child is adjudicated of an offense involving a controlled substance, or possession, carrying or use of deadly weapon or physical injury to another and authorize the county attorney to give the school a statement of facts in the case.
     SFA (1, E. Scorsone) - Make title amendment.
     SFA (3, R. Stivers) - Amend KRS 610.345 to require the court to notify a school principal within five days when a petition alleging a criminal offense is filed against a child attending that school; expands the list of felonies that would classify the child as a violent offender of which the principal shall be notified; and permit the notice to be released to school personnel that come in contact with the student offender.
     SFA (4, R. Roeding) - Amend to create a new section of KRS Chapter 158 to require that when a student's conduct on a school bus makes it unsafe, the driver shall take certain actions; require that the principal or the designee for school bus discipline assist the bus drivers with such problems; provide that a student who assaults or threatens a bus driver or other pupil on the bus be immediately suspended and a due process hearing scheduled within three days of the action, which could lead to suspension or expulsion under KRS 258.150; require that each school district have a plan of intervention for discipline problems; require each school district to train bus drivers in handling unsafe and aggressive student behavior.
     SFA (5, G. Neal) - Require that funds appropriated to support the school safety fund program in the biennial budget be allocated to local school districts on a per pupil basis; and provide state general funds to support the Center for School Safety and delete language to conform.
     SFA (6, G. Neal) - Add language to require that each local board of education adopt a policy to assure the implementation of the expulsion requirements under KRS 158.150 and to assure the safety of the students and staff.
     SFA (7, G. Neal) - Delete language relating to the right of school administrators, teachers, or other school personnel to immediately remove or cause to be removed threatening or violent students from a classroom setting or from the district transportation system pending further disciplinary action.
     SFA (8, G. Neal) - Delete language that requires the Kentucky Board of Education to promulgate appropriate administrative regulations relating to school safety, student discipline, and related matters; delete language that requires the Kentucky Department of Education to establish the criteria for distribution of funds in 1998-99 and to select the districts to receive funds.
     SFA (9, R. Stivers) - Require that grants be awarded for implementing proven programs, as opposed to developing innovative programs; require the district code to allow persons lawfully on school property to defend themselves by lawful means from attack.
