HB 150/FN (BR 1114) - J. Adams

     AN ACT relating to county and regional infrastructure development for economic development purposes.
     Create new sections of KRS Chapter 147A relating to county and regional infrastructure development for economic development purposes to state the intent of the bill; provide definitions; require area development districts to develop a regional infrastructure plan and establish minimum contents of the plan; require biennial review and amendment of plan if necessary; require distribution of plan as prescribed; require ADD's to assist local governments in formation and maintenance of infrastructure planning committee; establish membership of the committee; require county judge and prescribed mayors to appoint members of planning committees; require organizational meeting of the planning committee within 45 days of appointment of members; permit planning committee and regional development councils to adopt rules of procedure and select chair from membership for term of 1 year; require ADD's to form and maintain regional development councils as prescribed; require all meetings and records of the RDC's to comply with open meetings and records laws; require RDC's to provide biennial regional assessments with priorities for strategies; require the ADD boards to use the RDC's recommendations to compile regional infrastructure development plan; permit the Governor and state agencies to utilize regional infrastructure development plans to form state development plans and require state agencies to consider and determine if a government regulatory decision is consistent with state and regional infrastructure development plans.

HB 150 - AMENDMENTS


     HFA (1, J. Adams) - Retain original provisions and require regional planning committees in urban-counties to be created and appointed by the executive authority as prescribed, require all meetings of the planning committees be held in compliance with open records and meeting laws, require public hearings for all infrastructure development plans or amendments thereto in each county in a district, require a majority of the entire membership of a regional planning committee to take action, and require written statements by governmental entities outlining consistency of their activities with infrastructure development plans.
     SCA (1/FN, D. Karem) - Specify that in the case of a joint planning unit or in an urban-county government, that the joint planning commission or urban-county government shall perform the duties of the infrastructure planning committee; replace the creation of a regional development council with the regional planning council already in existence, and provide that the regional planning council perform the duties assigned to the regional development council.
     SFA (2, J. Rose) - Clarify that a level of adequate funding to support regional development plans be provided by the state with the existence of a written contract.
