HB 197 (BR 941) - G. Tapp, L. Belcher, R. Crimm

     AN ACT relating to penalties resulting in the suspension of the license plate and registration of a motor vehicle.
     Amend KRS 189A.070, relating to license revocations, to require a person convicted of a second or subsequent violation of KRS 189A.010 or 218A.993, to have the license plate and registration of all motor vehicles registered in the person's name suspended for six months; provide for the court to grant one vehicle to be used by a spouse or child if hardship provisions exist; require the court to review all vehicle transfers between the time a person is cited for a second or subsequent DUI; or second or subsequent conviction for illegal possession of controlled substances, and the person's court date to ensure that vehicles are not transferred in an attempt to circumvent the six month mandatory license plate suspension; provide for a one year suspension of the license plate and registration if the court determines that the transferred was not for bonafide reasons; amend KRS 189A.010, relating to penalties for operating a vehicle under the influence of drugs or alcohol, KRS 189A.080, relating to the surrender and return of suspended or revoked driver licenses, and KRS 218A.993, relating to penalties for violating the controlled substances act to conform.
