HB 204/FN (BR 950) - T. Burch, S. Nunn

     AN ACT relating to child protection.
     Amend KRS 620.040 to require Cabinet for Families and Children to perform investigation or assessment of reports; require cabinet to conduct risk and family assessment on reports of child abuse or neglect and permit referral to other agencies when indicated by assessments; permit information about reporting source to be shared with law enforcement agencies, agency designated to investigate or assess reports, or by court order after court review of case record and finding of reason to believe reporting source knowingly made a false report.

HB 204 - AMENDMENTS


     HCS/FN - Retain original provisions and require cabinet to retain all reports of suspected sexual abuse; require social workers to assist law enforcement with investigations of non-custodial sexual abuse; specify that search warrant is required to be requested rather than issued; and permit members of multidisciplinary teams to receive information about abuse reports.
     HFA (1, S. Nunn) - Retain original provisions except delete requirement that cabinet notify Kentucky State Police on a noncustodial abuse or neglect report; permit local law enforcement or prosecutors to request assistance from Kentucky State Police.
     HFA (2, S. Nunn) - Retain original provisions except delete reference to law enforcement and prosecutors relating to who is required to investigate reports of noncustodial abuse or neglect; permit the cabinet to participate in noncustodial abuse or neglect reports at the request of law enforcement or the Kentucky State Police.
     HFA (3, T. Riner) - Retain original provisions and add requirement that the cabinet report information on substantiated child abuse or neglect reports to employers conducting background checks for child care employees and family child care homes; include all cabinet records since 1972 or earlier; require cabinet to provide notice to subject of the substantiated report of the right to appeal the cabinet's finding.
     SCS/FN - Retain original provisions except specify duties when a report is made regarding abuse by a person other than parent; and require the cabinet to participate in investigations of noncustodial abuse at the request of law enforcement.
