HB 331/LM (BR 870) - H. Cornett, J. Gray

     AN ACT relating to the sale of confiscated firearms.
     Repeal KRS 16.220, relating to disposition of confiscated firearms, and KRS 45A.047 and 65.041, relating to disposition of firearms owned by local and state government units; amend KRS 16.210 and 95.435 to conform; amend KRS 237.090 to require forfeited firearms or ammunition to be destroyed, sold, or retained, rather than disposed of or retained; amend KRS 500.090 to remove requirement for public auction of confiscated firearms; remove requirement for proceeds from public auction to be used for purchase of body armor.

HB 331 - AMENDMENTS


     HFA (1, J. Gray) - Replace text of bill with new sections to amend KRS 95.435 to require that certain police departments transfer certain firearms to the state police; Amend KRS 500.090 to require certain firearms be transferred to the state police; Amend KRS 16.220 to provide a protocol for state police treatment of transferred firearms; Create a new section of KRS Chapter 500 to prohibit a law enforcement agency from retaining a firearm for the purpose of preventing its transfer to the state police.
     SFA (1, W. Blevins) - Extend the license to carry a concealed firearm to be effective for a period of five rather than three years.
     SFA (2/Title, W. Blevins) - Make title amendment.
     SFA (3, T. Shaughnessy) - Amend various sections of the bill to allow a local government the option of destroying confiscated firearms in addition to transfer to the state police for auction; amend KRS 237.070 and 527.040, to require that attempts by felons to purchase firearms be reported to the state police; create a new section of KRS Chapter 16 to require the state police to investigate felons attempting to purchase firearms.
     SFA (4, T. Shaughnessy) - Amend KRS 532.110, relating to concurrent and consecutive sentencing, to provide for consecutive sentencing for persons convicted of violating KRS 527.040, possession of a firearm by a convicted felon; amend KRS 533.060, relating to probation, to prohibit pretrial diversion and prerelease probation for persons convicted of using a firearm during the commission of a Class A to C felony or persons convicted of violating KRS 527.040, possession of a firearm by a convicted felon.
     SFA (5/Title, T. Shaughnessy) - Make title amendment.
     SFA (6, T. Shaughnessy) - Amend various sections of the bill to allow a local government the option of destroying confiscated firearms in addition to transfer to the state police for auction.
     SFA (7/Title, G. Neal) - Make title amendment.
     SFA (8/Title, D. Kelly) - Make title amendment.
     SFA (9, T. Shaughnessy) - Amend to add a section creating a new section of KRS Chapter 527 to make an attempt to purchase a firearm by a person prohibited by federal law from doing so a Class D felony.
