AN ACT relating to criminal justice.
Amend KRS 196.037 to allow probation and parole officers to have the powers of peace officers as to persons under their supervision; amend KRS 197.025 to place a twenty day limit on the time a prisoner has to appeal an open records decision; amend KRS 197.045 to eliminate the Department of Corrections' ability to eliminate good time for an inmate filing a lawsuit which was dismissed for being legally without merit; amend KRS 438.250 to allow testing of more than blood for possible communicable disease following an attack upon a public servant; amend KRS 439.563 to set out the Probation and Parole Board's responsibilities in regard to restitution; amend KRS 454.405 to restrict certain inmate legal actions; amend KRS 508.025 to expand the coverage of that crime to include any bodily fluid; amend KRS 510.120 expand the coverage of that crime to include sexual contact between a correctional employee or agent and an offender; amend KRS 532.043 to include KRS 529.030 and 531.320 within the coverage of the conditional discharge statute for certain sex offenses; amend KRS 533.025 to allow the Department of Corrections to remove a state prisoner serving time in a county facility into a state facility for treatment of certain medical conditions.
HB 475 - AMENDMENTS
HCS/CI - Permit a prisoner to challenge a denial of access to a public record by mailing or otherwise sending the appropriate documents to the Attorney General within 20 days of the denial; delete the provision which denies a prisoner the opportunity to file a suit under certain circumstances; hold a person guilty of sexual abuse in the second degree when that person subjects a prisoner to sexual contact; list medical conditions of an inmate in a county jail for which the Department of Corrections may provide medical treatment.
