AN ACT relating to health insurance.
Amend KRS 18A.225 to require the health insurance coverage for state employees to provide a mail-order drug option; require drug formulary changes to be filed with and approved by the commissioner of the Department of Insurance; restrict changes to drug formularies to quarterly changes; require insurers to provide the reason for drug formulary changes; require insurers to give at least 30 days notice of formulary changes approved by the commissioner to affected insureds in established treatment regimes involving maintenance drugs; permit the commissioner to grant exceptions to individuals to approved formulary changes under certain circumstances.
HB 598 - AMENDMENTS
HCS/FN - Retain original provisions except require insurer to maintain a formulary listing with Personnel Cabinet; prohibit any changes to the formulary unless changes filed with Personnel Cabinet; limit deletions from the formulary to a quarterly schedule; require notice to insured on maintenance drugs and permit waiver of the time frame for the notice when safety of the insured is at risk; permit appeal regarding formulary changes through the Personnel Cabinet.
HFA (1, S. Nunn) - Provide that health insurance policies for state employees shall require the policyholder to pay the same co-pay for the purchase of the same quantity of drugs regardless of whether the purchase is made through the mail order option or at a retail pharmacy.
HFA (2, R. Damron) - Require a pharmacy as a condition of participating in the state employee mail order drug option to demonstrate to the Secretary of the Finance and Administration Cabinet compliance with all requirements of KRS Chapters 315, 217, and 218A.
