AN ACT relating to the construction industry.
Create new sections of KRS Chapter 198B to establish definition section for contractor certification program; require commissioner of the Department of Housing, Buildings and Construction to develop and administer the program; establish fee, not to exceed $100, approved by the Kentucky Board of Housing, Buildings and Construction, for certification; create a uniform definition for enforcement purposes of "independent contractor"; recognize proofs provided in KRS 198B.595, KRS 198B.668, and KRS 227.480 as well as existing builders' or contractors' certification or registration programs in place on July 15, 1999; require state agencies to coordinate enforcement activities and avoid duplication regarding compliance; require contractors of: underground storage tanks; fire protection sprinkler; electrical; heating, ventilation and air conditioning; plumbing; and installers of boilers to be in compliance on January 1, 2001; require all other contractors to be in compliance on January 1, 2002; establish penalties for violators and repeat offenders; and amend KRS 198B.060 to require proof of compliance before being issued a building permit.
HB 606 - AMENDMENTS
HFA (1, H. Collins) - Retain all provisions of the bill, except that the contractor certification program shall not apply to those contractors who have no more than 2 employees, whether full time or part time employees.
HFA (2, J. Haydon) - Retain all provisions of the bill except, contractors shall not mean one who undertakes a project that does not exceed the cost of $1,000; recognize proofs provided by liquefied petroleum gas; require the commissioner to promulgate administrative regulations of procedures to show compliance; remove agreement with the Department of Highways that allows that department to prequalify its contractors; amend KRS 176.130 to include proof of compliance with Sections 1 to 7 of this Act be include in the application process for a certificate of eligibility.
