AN ACT relating to advance directives.
Create a new section of KRS 205.510 to 205.645 to require the Department for Medicaid Services to submit any necessary waivers to the federal Health Care Financing Administration to require Medicaid providers to keep a copy of each Medicaid patient's advance directive in the medical record and to require Medicaid recipients to complete an advance directive; create a new section of subtitle 18 of KRS Chapter 304 to require individuals insured under the state health insurance plan to complete an advance directive; require any insurance company providing health insurance coverage under the state health plan to require all providers to keep a copy of the advance directive for each patient insured under the state health insurance plan in the medical record; authorize the Department for Medicaid Services, Personnel Cabinet, and the Department of Insurance to promulgate administrative regulations; amend KRS 311.633 to prohibit discriminatory practice against health care providers and health care facilities for following a patient's advance directive; amend KRS 311.635 to make all health care practitioners immune from liability for following a patient's advance directive; amend KRS 311.637 to conform.
