HB 734/LM (BR 95) - R. Damron

     AN ACT relating to the Court of Justice.
     Create new sections of KRS Chapter 26A to require the Chief Justice to issue guidelines on the design, financing, and construction of court facilities, and to develop Kentucky standards for court facilities construction; require the Administrative Office of the Courts (AOC) to assess the need for court projects, develop project programs with cost estimates, develop a prioritized list, certify the county's ability to pay for the project, and develop and maintain uniform contracts to be used by local governments when procuring services for court projects; require local units of government to enter into a memorandum of agreement with AOC specifying rights, duties, and obligations relating to court projects; require AOC approval of all contracts for the design, financing, or construction of court projects; require all court projects to comply with Kentucky standards; require the judicial branch budget recommendation to specify a maximum authorized bond term for court projects; require bond terms to be limited to the term specified in the budget bill unless approved by AOC after legislative committee review; create a use allowance contingency fund for up to 15% cost overruns on court projects; specify legislative committee review process for obtaining contingency account funds; require AOC quarterly to report the status of all outstanding court projects to the Capital Project and Bond Oversight Committee; amend KRS 26A.090 to add the director of the AOC to the Court Facilities Standards Committee; amend KRS 147A.021 to require the Department for Local Government to evaluate the financial condition of any local government selected to participate in a court project and to provide this information to AOC when requested.

Damron) - Change the court facilities that would be affected by this legislation; change the definition of use allowance; delete the provision requiring all investment earnings from the court facility use allowance contingency fund to be credited back to the fund; make a technical correction.
