HB 788 (BR 1536) - R. Webb, J. Stacy

     AN ACT relating to check authorization companies.
     Create new sections of KRS Chapter 367 to require a retail seller to post in its place of business its check acceptance policy and the fee it charges for returned checks; require a retail seller that uses the services of a check authorization company to so state in its check acceptance policy; require a check authorization company, upon request by a consumer, to provide information in the consumer's file, a list of risk assessment factors, a summary of the consumer's rights, and a toll-free telephone number; permit a check authorization company to require identification from the consumer making the request; provide that if a consumer disputes information the check authorization company must investigate the disputed information and modify or delete the information within 30 days if the information is found to be inaccurate or incomplete or cannot be verified; authorize a consumer to bring an action in a court of competent jurisdiction against a check authorization company that violates this Act.
