HB 920 (BR 1250) - R. Wilkey, G. Lindsay
AN ACT relating to fines, costs, fees, and other court-generated revenues and their disposition.
Amend KRS 23A.205, relating to court costs in criminal cases in the Circuit Court to set costs at $100; amend KRS 24A.175, relating to court costs in criminal cases in the District Court to set costs at $100 whether the offense is prepayable or not; amend and repeal numerous other sections to eliminate separate add-on costs, specialized disposition of fines, and payments to be made through the Circuit Court.
HB 920 - AMENDMENTS
HCS/LM - Amend KRS 23A.205 to increase the document copying fee from $0.15 to $0.35 per page, amend KRS 23A.205 and KRS 24A.175 to increase court costs to $100, to delete provisions requiring circuit clerks to make separate disbursements to sheriff, county jail expenses, and the Kentucky Local Correctional Facilities Construction Authority, and to require clerks to instead pay the entire $100 of each court cost to the court cost distribution fund; create the court cost distribution fund to be administered by the Finance and Administration Cabinet; require the fund to make disbursements as follows: $10 to the sheriff of the county in which the fee was paid, $10 to the Kentucky Local Correctional Facilities Construction Authority, $5 to the traumatic brain injury fund, $3 to the Administrative Office of the Courts for deputy clerk enhancement $2 to fiscal courts for paying expenses, $2 to be paid to the crime victims' compensation fund; delete requirements for defendants to pay restitution directly to the crime victim; and amend KRS 189A.010(10) to delete the $20 fee to be paid to the traumatic brain injury trust fund.

Wilkey) - Require clerk to make reports to the Finance and Administration Cabinet and the Administrative Office of the Courts of the amounts to be distributed from each court cost; undelete KRS189.394(8), which creates the highway work zone safety fund; require an order of priority in which the court cost distribution fund must pay partially paid court costs; change amount given to crime victims' compensation fund from $2 to $3; change amount given to spinal cord and head injury research trust fund from $5 to $6; exempt court costs from the 5% amount assessed by the circuit clerk for enhancement of deputy clerk salaries under KRS 30A.200; add a section amending KRS 211.500 to delete provision prohibiting a member who serves two consecutive full four year terms from being reappointed for years thereafter.
