SB 147/FN (BR 355) - R. Sanders Jr

     AN ACT relating to wetland and stream mitigation.
     Create a new section of KRS 146.410 to 146.530, relating to the Nature Preserves Commission, to require the commission to undertake any compensatory wetland mitigation that is required as a result of road projects of the Transportation Cabinet.

SB 147 - AMENDMENTS


     SCS/FN - Delete original provisions of the bill and insert new language establishing a new section of KRS Chapter 150 which gives the Department of the Fish and Wildlife the authority to undertake compensatory mitigation projects for other state agencies or other entities, allows the department to establish mitigation banks to restore or create wetlands prior to the need for wetland mitigation, and establishes the Kentucky Wetland and Stream Mitigation Fund to accept funds, gifts and grants to carry out the provisions of the Act.
     SCA (1/Title, R. Sanders Jr) - Make title amendment.
     SFA (2, R. Sanders Jr) - Eliminate fees as an option in lieu of mitigation.
