SB 175 (BR 1944) - T. Buford

     AN ACT relating to state government.
     Create new sections of KRS Chapter 6 to establish the Sunset Review Advisory Committee of the General Assembly; require the committee to review each administrative body in state government prior to January 1, 2002; specify matters to be reviewed; require the committee to report its findings to the Legislative Research Commission, the Governor, and the administrative body reviewed; direct the Legislative Research Commission to provide staff services to the committee; direct the Governor, Auditor of Public Accounts, the Finance and Administration Cabinet, and other state agencies to assist the committee with information needed for its reports and recommendations; amend KRS 12.015 and 12.029 to require administrative bodies to file an annual financial report; require administrative bodies established by executive or administrative order, except an executive order filed under KRS 12.028, to expire no later than one hundred eighty days following the end of the term of the Governor by or under whom the administrative body was created; repeal Sunset Advisory Committee effective April 15, 2002.

SB 175 - AMENDMENTS


     SCA (1, A. Robinson) - Eliminate the Sunset Review Advisory Committee and assign its duties to the Legislative Program Review and Investigations Committee.
     SFA (2, K. Stine) - Create new sections of KRS Chapters 45A and 176 to require the Finance and Administration Cabinet and the Department of Highways to make all real property appraisers applying for prequalification subject to the same prequalification standards; require an appraiser prequalified without successful completion of any written examination established for prequalification to successfully pass the examination within 6 months to remain prequalified; require re-examination of previously prequalified appraisers when changes in appraisal standards require a material change in any prequalification test.
     SFA (3, R. Sanders Jr) - Delete the original provisions; amend KRS 6.900 to define terms; create a new Section of KRS Chapter 6 to require the Governor's office to provide a list of all executive branch administrative bodies to the Program Review and Investigations Committee with certain additional information; require that each administrative body submit information on its purpose, workload, staffing, past and anticipated budgets, number of members and their compensation, a statement demonstrating a public need for the body's existence, and salaries and expenses; require the Program Review and Investigations Committee to develop a priority schedule for reviews of individual administrative bodies; permit hearings to consider the usefulness, performance, and effectiveness of administrative bodies; establish criteria to be utilized for the reviews; require that the Program Review and Investigations Committee to report to the Governor, the administrative body, and LRC, with a recommendation; require any bill that would abolish, transfer, or reorganize an agency to contain a schedule for it to conclude its business; require agencies to provide information needed for reports and recommendations; amend KRS 12.015 to require annual financial reports of administrative bodies; require administrative bodies established by executive order of the Governor whose members are appointed by the Governor to expire 180 days after the Governor's term unless the body has been established by statute; require an administrative body established by administrative order established by an appointee of the Governor to expire 180 days after the Governor's term ends, unless there is an earlier expiration date.
