SB 209/LM/CI (BR 372) - E. Harris

     AN ACT relating to crimes and punishments.
     Create a new section of KRS Chapter 525 to create the crime of assaulting an animal in the first degree when an animal dies or suffers serious physical injury as a Class D felony; create a new section of KRS Chapter 525 to create the crime of assaulting an animal in the second degree when an animal suffers physical injury as a Class A misdemeanor; create a new section of KRS Chapter 436 to create the crime of animal neglect as a misdemeanor with a $5,000 fine or 12 months in jail or both; amend KRS 525.025 relating to cruelty to animals in the first degree to eliminate the exemption for dog training if the training is designed to teach a dog to fight for fun or profit; amend KRS 525.030 relating to cruelty to animals in the second degree to eliminate elements relating to neglect, beating, torturing, and similar offenses; amend 436.605 relating to dog wardens and animal cruelty society agents to specify which KRS sections they shall enforce; permit confiscation of animals that are the subject of abuse or neglect.

SB 209 - AMENDMENTS


     SCS - Limit bill to court ordered psychological counseling for a person who commits the crime of cruelty to animals and under some circumstances permitting courts to order the forfeiture of an animal that has been the victim of cruelty.
     SFA (1, E. Harris) - Remove provision relating to animal forfeiture.
