AN ACT relating to employers.
Create a new section of KRS Chapter 337 to provide an employer, who gives an employment reference, protection from liability in a civil action by an employee, prospective employer, or any other person harmed as a result of his having made the disclosure, unless the plaintiff in the civil action can prove by clear and convincing evidence that the employer disclosed information he knew to be false with the deliberate intent to mislead the prospective employer or others, or that the disclosure of particular information was discriminatory under KRS Chapter 344; requires the court, if the verdict favors the defendant, and the lawsuit is determined to have been frivolous or harassing conduct, to order the plaintiff to pay reasonable attorney's fees and court costs to the defendant; establish that the section does not create a new cause of action against an employer nor does it affect any immunities from civil liability or defenses established under the Kentucky Revised Statutes, common law, or that the employer may be entitled to not covered by the section.
