AN ACT relating to private investigators.
Create new sections of KRS Chapter 367 to make it an unfair, false, misleading, or deceptive act for a person to engage in the practice of private investigating without meeting eligibility requirements, to hire someone to engage in the practice of private investigating if that person has not registered with the Attorney General's Office, and to use an alias, mislead a client, disclose privileged information, or obtain information through threats while engaging in private investigating; proscribe certain conduct; subject violators to same penalties set out for violations of KRS 367.190; permit an injured party to sue the person hiring the private investigator for damages if the person hiring knows that the person engaging in private investigating is not registered, directs the persons to do the injurious conduct, or knows or has reason to know that the person hired is doing the injurious conduct; provide that the remedy afforded the injured party is not offset by the remedies given the Attorney General.
