HB 241 (BR 24) - S. Nunn, M. Marzian, J. Coleman, B. Colter, R. Damron, M. Denham, S. Westrom

     AN ACT relating to immunization registries.
     Create a new section of KRS Chapter 214 to permit the Cabinet for Health Services to create a childhood immunization registry and pursue federal and other funding; require design under recommendations from the Center on Disease Control: require information from birth certificates for children born after January 1, 2002 and immunization records for all children age 6 and under on January 1, 2002; specify that the information contained in the registry shall be determined by administrative regulations that shall include confidentiality requirements, release of information to health care providers, parents, or guardians, local health departments, and individuals and organizations with a need to verify immunization status for enrollment purposes; require timely reporting by those who administer immunizations, methods to permit parents or guardians to decline to enroll in the registry, and penalties for unauthorized disclosure of information; permit information to be obtained from clinics, billing data, and vital statistic records; provide immunity from civil or criminal liability for providers who use the registry; require the cabinet to report to the Governor and General Assembly by October 30 each year.

HB 241 - AMENDMENTS


     HCS - Retain original provisions and specify that immunity from civil or criminal liability shall be provided except for actions or inactions involving negligence, gross negligence, or intentional conduct.
     HFA (1, R. Damron) - Amend to add that the registry may also contain immunization records of other age groups or individuals.
