AN ACT relating to crimes and punishments.
     Amend KRS 532.031 to require that the jury, rather than the sentencing judge, determine whether a hate crime has been committed; except in the case of a capital offense or a Class A felony, set the penalty for a hate crime at one level higher than if the offense were not a hate crime.
