AN ACT relating to state procurement.
     Create various new sections of KRS Chapter 45A to define "grown," "end-product," "unreasonable cost," and "resident bidder or offeror"; establish guidelines for establishing acceptable proof that a bidder or offeror is a Kentucky resident who bids or offers end-products grown in the state; establish conditions of being awarded a contract using the preference provisions; direct that in the case of a request for resident bidder or offeror status, the requirements apply to the entire solicitation; direct that in the case of a request for end-product status, the requirement apply to each line item or each lot in a solicitation to which a separate, responsive bid or offer may be made; direct that a 5% preference of the scoring or pricing methodology described in the applicable solicitation or bid document be allowed to those bidders who are residents of, or whose products or services are grown in, Kentucky; prohibit the preferences from affecting bordering states except under certain conditions; direct that preference not apply to noncompetitive negotiations or small purchases procurement; set penalties for false certification and for bidders who were awarded a contract that was based on invalid certification; prohibit a bidder who does not request a preference at the time of submission of the bid or offer from claiming any preference against another bidder or being protected from application of another bidder's claim to a preference against his bid or offer in determining contract award; direct that the protest provisions of KRS 45A.285 and 45A.290 not apply to the provisions and requirements of Sections 1 to 5 of this Act.
