HB 63 (BR 66) - G. Lindsay, B. Colter

     AN ACT relating to domestic violence.
     Amend KRS 403.740 and 403.750, relating to domestic violence, to require a court issuing an emergency protective order or domestic violence order to also issue a restraining order or injunction against the petitioning party prohibiting contact or communication with the respondent to the emergency protective order or domestic violence order.

HB 63 - AMENDMENTS


     HCS - Delete all new language; permit a person who is the subject of a petition for an emergency protective order or domestic violence order to obtain an emergency protective order or domestic violence order back against the petitioner.
     SFA (1/P, D. Adams) - Amend to require that if a petition for an emergency protective order is dismissed prior to the issuance of a domestic violence order that the court shall order expungement of all records of the petition.
     SFA (2, J. Denton) - Amend to create a new section of KRS Chapter 527 to prohibit possession of a firearm by a person subject to a domestic violence order and prohibit retroactive application.
     SFA (3, D. Adams) - Amend to establish the procedure for a person to follow in making a motion to expunge an emergency protective order; establish the standards for a court to employ when determining whether to grant the motion.
     SFA (4, D. Adams) - Amend to establish the procedure for a person to follow in making a motion to expunge an emergency protective order; require that notice of the expungement motion be provided to the local office of the Department for Community Based Services at least seven (7) days prior to the expungement hearing; establish standards for a court to employ when determining whether to grant the motion to expunge an emergency protective order.
