HB 79/FN (BR 258) - H. Moberly, M. Marzian, R. Meeks, R. Nelson, J. Stewart

     AN ACT relating to the Support Education Excellence in Kentucky (SEEK) Program and making an appropriation therefor.
     Create a new section of KRS 157.310 to 157.440 to provide that 95% of the excess funds that exist after the SEEK base and adjustment factors have been fully funded in fiscal year 2001-2002 shall be reallocated and appropriated for one-time salary awards; provide that the remaining unexpended funds shall not lapse but be carried forward into fiscal year 2002-2003 to provide incentive funds during fiscal year 2002-2003 to local school districts and that the General Assembly in the 2002 Regular Session shall determine the criteria for the distribution of the funds.

HB 79 - AMENDMENTS


     HCS/FN - Retain original provisions; define "certified employee," "classified employee," and "part-time employee;" distribute 70% of salary award to certified employees and 30% to classified employees; make technical corrections.
     HFA (1/Title, J. Barrows) - Make title amendment.
     HFA (2, J. Barrows) - Delete the original provisions and provide that notwithstanding 2000 Ky. Acts Chapter 549 and any other statutory provisions to the contrary that any excess funds after the SEEK base and all SEEK adjustments have been made for fiscal year 2001-2002 shall not be reallocated to provide additional funding to local school districts but shall be appropriated by the General Assembly in the 2002 Regular Session; amend 2000 Kentucky Acts Chapter 549 to provide that any excess funds after the SEEK base and all SEEK adjustments have been made for fiscal year 2001-2002 shall be exempt from the General Fund Budget Reduction Plan except as may be required under subsection (7) of the General Fund Budget Reduction Plan; provide that the provisions of this Act shall supersede and prevail over any conflicting provisions of the State/Executive Budget memorandum.
