SB 101/CI (BR 482) - D. Kelly, D. Mongiardo

     AN ACT relating to controlled substances.
     Amend KRS 218A.050 relating to Schedule I controlled substances, to add flunitrazepam (Rohypnol) as a Schedule I controlled substance.

SB 101 - AMENDMENTS


     SFA (1, D. Kelly) - Delete original provisions; amend KRS 218A.1412 relating to trafficking in controlled substance in the first degree to add flunitrazepam (rohypnol); amend KRS 218A.1415 relating to possession of a controlled substance in the first degree to add flunitrazepam (rohypnol).
     HCS/CI - Add new Section 3, amending KRS 218A.1432 to provide a definition of "chemicals" in subparagraph (1)(b).
     HFA (1/Title, J. Coleman) - Make title amendment.
     HFA (2, J. Coleman) - Retain original provisions except amend KRS 218A.180 to require any prescription for oxycodone hydrochloride or morphine sulfate to have the diagnosis on the prescription; limit the dispensing of oxycodone hydrochloride to diagnoses approved by the federal Food and Drug Administration or listed on the manufacturer's labeling; and require pharmacists to maintain confidentiality of a patient's diagnosis; EMERGENCY.
     HFA (3, R. Palumbo) - Amend KRS 510.050, KRS 510.080, and KRS 510.110 to include provisions relating to administration of controlled substances or legend drugs for purposes of committing various sex crimes.
     HFA (4/Title, R. Palumbo) - Make title amendment.
     HFA (5/Title, R. Palumbo) - Make title amendment.
     HFA (6, R. Damron) - Attach the provisions of HB 377/HCS; attach the provisions of SB 160/GA; attach the provisions of SB 7/GA; attach the provision of SB 7; and specify that drugs dispensed by health department or charitable health provider must meet the requirements of KRS Chapter 217 and be prescribed by a practitioner under KRS 217.015; amend KRS 212.230, 212.628, and 212.784 to require local, district, and independent boards of health to adopt a policy on dispensing medication and a policy on parental consent for minors.
     HFA (7/Title, R. Damron) - Make title amendment.
     HFA (8, R. Wilkey) - Delete original provisions of bill, replace with amended KRS 218A.1432 to specify which chemicals constitute the chemicals which are essential to the production of methamphetamine and which bring one within the provisions of the law.
