     AN ACT relating to Medicaid and declaring an emergency.
     Amend KRS 6.940 to change name to Medicaid Oversight Advisory Committee from Medicaid Managed Care Oversight Advisory Committee; expand oversight to the general Medicaid program, remedies to limitations on access to services, health professional shortages, increases or decreases in fees, changes in cabinet or department policy relating to Medicaid, and changes in benefits; create a new section of KRS 205.510 to 205.645 to require the Cabinet for Health Services or Department for Medicaid Services to comply with requests for information within 5 days or make written explanation of any liability; require the cabinet or department to inform the committee about changes in Medicaid administrative regulations before filing a notice of intent or emergency regulation; permit committee to hold a public meeting on the proposed changes within 30 days; EMERGENCY.

SB 158 - AMENDMENTS


     SFA (1, D. Karem) - Amend to require the Department for Medicaid Services to produce requested documents as well as information; lengthen period of time for production from 5 to 10 days; delete requirement that department wait 30 days before taking further administrative action after providing notice of subject matter or proposed action to the Medicaid Managed Care Oversight Advisory Committee.
     SFA (2, D. Mongiardo) - Amend KRS 6.940 to create the Medicaid provider advisory board, to be appointed by the co-chairs of the Medicaid Managed Care Oversight Advisory Committee; specify membership to include representation of 12 physicians, 2 nurses, an independent pharmacist, a physician assistant, an optometrist, a chiropractor, the president of a hospital, a rural health center representative, 3 hospital administrators, a community mental health center representative, a field representative of a pharmaceutical company, an at-large member with knowledge of Medicaid, and 3 consumers; and specify that board shall meet only on the day of a meeting of the committee, but permit the board to meet more often with approval of the Legislative Research Commission.

     SFA (5, D. Karem) - Require Department for Medicaid Services to produce requested documents as well as information; lengthen period of time for production from 5 to 10 days; delete requirement that department wait 30 days before taking further administrative action after providing notice of subject matter or proposed action to the Medicaid Managed Care Oversight Advisory Committee; require department, whenever possible, to provide 5 days of advance notification to the committee prior to promulgating an emergency administrative regulation.
     HCS - Retain original provisions, except provide for appointments to the Medicaid provider advisory board to be made by co-chairs of the Interim Joint Committee on Health and Welfare, rather than the co-chairs of the Medicaid oversight advisory committee; add a representative of hospice to provider advisory board; increase nurse presentation on the provider advisory board from 3 to 6; and clarify that the provider advisory board may meet on days other than a meeting of the oversight advisory committee, with approval of the Legislative Research Commission.
     HFA (1, J. Coleman) - Retain original provisions except expand the membership of the Medicaid provider advisory board to include a home health representative.
     HFA (2, M. Marzian) - Retain original provisions except amend KRS 314.011 to delete the definition for "dispense".
     HFA (3/Title, M. Marzian) - Make title amendment.
