HB 100/LM (BR 1170) - R. Wilkey, J. Vincent
AN ACT relating to crimes and punishments.
Amend KRS 189A.010 to delete requirement relating to operation of motor vehicle for first time offenders; amend KRS 189A.103 to delete requirement that 20 minute observation period begin at the testing location; amend KRS 189A.105 to specify new warnings given at DUI testing and to delete provisions relating to attorney contact and subsequent testing by the defendant; amend KRS 189A.104 to delete requirement that testing apparatus be at a police station or testing facility; amend KRS 189A.107 to specify a revised license suspension period.
HB 100 - AMENDMENTS
HCS/LM - Delete Sections 1 and 2 of the bill which amended KRS 189A.010 and KRS 189A.103.
HCA (1/Title, R. Wilkey) - Make title amendment.
HFA (1, B. Yonts) - Remove sections 3 and 4 and change language of warning to conform.
SCS/LM - Amend KRS 189A.107 to require the court, upon a defendant's conviction of a violation of KRS 189A.010(1), to determine if the defendant refused to take the alcohol test; delete Section 4 which amended KRS 189A.200 with a conforming amendment; delete Section 5 which declared an emergency to exist.
SCA (1/Title, R. Stivers) - Make title amendment.
SFA (2, D. Seum) - Amend KRS 532.025 relating to the death penalty to allow a sentence of death for kidnapping if the kidnapped person dies as a result of the kidnapping and to allow kidnapping to serve as an aggravating circumstance in a murder prosecution.
SFA (3, R. Stivers) - Require that when a peace officer stops a person under the age of 21 for DUI, the peace officer shall inform the person that if he or she registers 0.02 or greater on the DUI test, then he or she shall be subject to criminal penalties.
