HB 104/LM (BR 246) - J. Jenkins, J. Arnold Jr

     AN ACT relating to workers' compensation.
     Amend KRS 342.680 to provide that there exists a presumption that heart or lung disease in a firefighter is occupationally related if the employee has worked as a firefighter for five (5) years or more.

HB 104 - AMENDMENTS


     HFA (1, J. Jenkins) - Provide a presumption that heart and lung disease for a firefighter is job related.

     HFA (2, J. Turner) - Clarify that for purposes of a workers' compensation claim by a firefighter, based on a heart or lung condition, such condition is presumed to be work-related if the firefighter is paid or is a volunteer, has served as a firefighter for a minimum of 5 consecutive years, and has been actively engaged in firefighting activities.

     HFA (3, S. Westrom) - Amend KRS 342.680 to provide a presumption that depression or other mental health conditions, in a legislator, are occupationally-related if he or she has served for at least two years; provide an irrebuttable presumption that the condition is occupationally-related if a legislator serves during a year in which redistricting occurs.
