AN ACT relating to traffic regulations.
Create a new section of KRS Chapter 189, relating to traffic regulations, to define "bill of lading", "building materials", and "home"; allow overweight or overdimensional vehicles to haul building materials to a home over any state road without a permit and without being subject to a fine if the vehicle is within the limits of the registration issued to the vehicle and within axle limits; permit the operator of the vehicle to determine the most direct route for delivering the building materials; require the operator of the vehicle to have in his or her possession a bill of lading when hauling building materials; amend KRS 189.221, relating to weight and dimension limits for trucks, and KRS 189.230, relating to the reduction of load limits, to conform.
HB 12 - AMENDMENTS
HFA (1, J. Lee) - Add a new subsection (4) to Section 1 to prohibit vehicles hauling building materials from exceeding established width limits and posted bridge limits for any route the vehicle travels; require a vehicle hauling building materials that exceeds width and bridge limits to obtain the appropriate permit from the Transportation Cabinet.
HFA (2, R. Damron) - Exclude counties with a population of 30,000 or more from the weight limit exceptions for building materials.
HFA (3, R. Damron) - Exclude counties with a population of 20,000 or more from the weight limit exceptions for building materials.
HFA (4, R. Damron) - Exclude counties with a population of 25,000 or more from the weight limit exceptions for building materials.
HFA (5, J. Lee) - In Section 1, delete subsections (2) and (3) in their entirety, and insert in lieu thereof new subsections (2), (3), and (4) to prohibit vehicles that exceed 96 inches in width from hauling building materials on a single "A" highway without an overdimensional permit from the Transportation Cabinet; prohibit vehicles hauling building materials on any road from exceeding the established width limits and posted bridge weight limits for the road unless the operator of the vehicle has obtained the appropriate overdimensional or overweight permit from the cabinet.
HFA (6, J. Lee) - In Section 1, subsection (1) add a new definition of "state road"; delete subsections (2) and (3) of Section 1 in their entirety, and insert in lieu thereof new subsections (2), (3), and (4) to prohibit vehicles that exceed 96 inches in width from hauling building materials on a single "A" highway without an overdimensional permit from the Transportation Cabinet; prohibit vehicles hauling building materials on any road from exceeding the established width limits and posted bridge weight limits for the road unless the operator of the vehicle has obtained the appropriate overdimensional or overweight permit from the cabinet.
SCS/FN - Retain the original provisions of the bill and insert the following: amend KRS 189.222 to allow trucks weighing up to 80,000 pounds to operate on any state highway if the truck does not exceed its weight limit and if the truck is carrying farm or forest products from their point of origin to first market or agricultural equipment; amend KRS 138.210 to delete the definition of "average wholesale price" for gasoline; amend KRS 138.220 to set a flat tax rate of $0.15 per gallon on gasoline and $0.12 per gallon on special fuels and eliminate indexing the tax rate to the average wholesale price; amend KRS 138.470 to exempt motor vehicles 55,000 pounds or greater and farm trucks 55,000 pounds or greater from usage tax; amend KRS 139.480 to exempt from sales tax repair and replacement parts for motor vehicles 55,000 pounds or greater and farm trucks 55,000 pounds or greater; amend KRS 186.040 to require persons registering motor vehicles 55,000 pounds or greater to pay an additional $20 County Clerk fee; amend KRS 186.050 to require person registering motor vehicles 55,000 pounds or greater to pay an additional $20 registration fee to be deposited in a special account within the road fund to be used exclusively to perform highway maintenance; amend KRS 138.660, 138.270, 138.695, 235.085, 42.409, 138.450, 234.320, and 234.380 to conform; require the Transportation Cabinet to conduct an advertising campaign during the Fall of 2002 to encourage trucking companies to relocate their vehicles to Kentucky; repeal KRS 175.505, relating to the debt payment acceleration fund; give Act the short title of the "Kentucky Transportation Revitalization Act of 2002"; make sales tax exemption effective 7/1/2003; make usage tax exemption, gas tax provisions, and fee increases effective 1/1/2003.
SCA (1/Title, V. Moore) - Make title amendment.
SFA (2/FN, V. Moore) - Amend Section 8 of the bill to eliminate the weight distance tax paid by motor vehicles in excess of 59,999 pounds; amend KRS 138.655, 138.665, and 138.690 to conform; make weight distance elimination effective 1/1/2003.
SFA (3, D. Seum) - Add a new Section 19 to amend KRS 189.285 to exclude from the definition of a "motorcycle" electric vehicles with three wheels; renumber remaining sections accordingly.
