HB 129 (BR 956) - M. Cherry, J. Crenshaw, R. Meeks

     AN ACT relating to price controls.
     Create a new section of KRS Chapter 39A to permit the Governor to issue an executive order freezing prices following an act of war, terrorism, national security event, or similar event affecting the Commonwealth and provide methods for enforcement of the order.

HB 129 - AMENDMENTS


     HCS - Create a new section of KRS Chapter 39A to define "commodity" and "unconscionable"; permit the Governor to issue an executive order declaring an emergency following an event of national security affecting the Commonwealth; prohibit during the emergency period the selling of commodities at an unconscionable price; allow emergency order to be extended for seven days period not to exceed a total of twenty-one days; specify that the Attorney General have enforcement jurisdiction over violations.

     HFA (1, M. Cherry) - Delete the provision relating to sales by growers, producers, or processors of raw or processed food products.

     HFA (2, M. Cherry) - Require the Division of Emergency Services to provide notification of the emergency declaration and prohibit any action for violations after 180 days of termination of emergency declaration.
